{"id":148422,"date":"2019-07-10T18:05:39","date_gmt":"2019-07-10T10:05:39","guid":{"rendered":"https:\/\/www.geek.com\/featured\/-1795104\/"},"modified":"2019-07-10T18:05:39","modified_gmt":"2019-07-10T10:05:39","slug":"federal-court-rules-trump-cant-block-haters-on-twitter","status":"publish","type":"post","link":"https:\/\/itteacheritfreelance.hk\/test\/wordpress\/2019\/07\/10\/federal-court-rules-trump-cant-block-haters-on-twitter\/","title":{"rendered":"Federal Court Rules Trump Can\u2019t Block Haters on Twitter"},"content":{"rendered":"<figure>\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/www.geek.com\/wp-content\/uploads\/2017\/12\/trump-cnn-650x366.jpg?resize=640%2C360&#038;ssl=1\" width=\"640\" height=\"360\" data-recalc-dims=\"1\" \/><\/p>\n<div class=\"figcaption\">Tweeter-in-Chief Donald Trump (via CNN)<\/div>\n<\/figure>\n<p><span style=\"font-weight: 400;\">A federal appeals court upheld a previous ruling that President Donald Trump engaged in unconstitutional discrimination by blocking dissenters on Twitter.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Manhattan&#8217;s 2nd U.S. Circuit Court of Appeals this week <a href=\"https:\/\/knightcolumbia.org\/sites\/default\/files\/content\/Cases\/Twitter\/2019.07.09_Opinion.pdf\"  rel=\"noopener\">agreed<\/a> that as long as Trump is a public official, he cannot prevent people from reading or responding to his feed simply because he disagrees with them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In July 2017, the Knight First Amendment Institute at Columbia University\u2014on behalf of seven individuals blocked by Trump after criticizing his policies\u2014<a href=\"https:\/\/knightcolumbia.org\/news\/knight-institute-demands-president-unblock-critics-twitter\"  rel=\"noopener\">sued the president<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The suit claimed that Trump&#8217;s Twitter account (@realDonaldTrump) is a public forum and official voice of the administration, and that excluding people from accessing it is a First Amendment violation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Former White House Press Secretary Sean Spicer and White House Director of Social Media Daniel Scavino were also named in the lawsuit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Almost a year later, the U.S. District Court for the Southern District of New York <a href=\"https:\/\/knightcolumbia.org\/news\/federal-court-rules-president-trumps-blocking-twitter-critics-violates-first-amendment\"  rel=\"noopener\">held that<\/a> the president&#8217;s Twitter account constitutes a &#8220;public forum,&#8221; and therefore cannot bar speakers on the basis of viewpoint.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some 75 users have since been unblocked, though another 30 or so remain stonewalled\u2014including model Chrissy Teigen and comedian Rosie O&#8217;Donnell, <a href=\"https:\/\/www.apnews.com\/082811d287774a5a8b2a9692c4195a4b\"  rel=\"noopener\">the Associated Press reported<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Public officials&#8217; social media accounts are now among the most significant forums for discussion of government policy,&#8221; Jameel Jaffer, the Knight Institute&#8217;s executive director, <a href=\"https:\/\/knightcolumbia.org\/news\/second-circuit-holds-president-trump-violated-first-amendment-blocking-critics-twitter\"  rel=\"noopener\">said in a statement<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;This decision will ensure that people aren&#8217;t excluded from these forums simply because of their viewpoints,&#8221; the attorney continued. &#8220;And that public officials aren&#8217;t insulated from their constituents&#8217; criticism.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Evidence of the official nature of Trump&#8217;s Twitter account\u2014first created in 2009, now operating in tandem with the @POTUS feed\u2014is &#8220;overwhelming.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Once the president has chosen a platform and opened up its interactive space to millions of users and participants, he may not selectively exclude those whose views he disagrees with,&#8221; according to the unanimous judgement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Department of Justice is understandably disappointed by the ruling.
