Zack Snyder faces yet another bump in the road on his way to bring a new version of Justice League to the fans who demanded it. Though the project is finally a reality and will in fact be coming to HBO Max for real, it’s still not immune to the usual problems and hold ups of any other film. Not too long ago, the acclaimed director released a brand new trailer for his alternate take of the film, which was set to a version of Leonard Cohen’s “Hallelujah,” one of Snyder’s favorites. This however, has now resulted in the trailer being taking down over a music rights dispute.
While there has been no official word on why exactly it was taken down, reporter Aaron Couch tweeted that HBO Max had pulled the trailer itself upon being notified of a music rights dispute. Considering “Hallelujah” is one of the trailer’s most prominent elements, it also seems to be the likely point of contention for why it had to come down. For now, HBO Max and Snyder have a few options, ranging from settling the dispute with the rights holders, to editing in a new song, to potentially just producing a brand new trailer. It is worth noting that this seems to have been a voluntary decision from HBO Max, as re-uploads of the trailer by other sites are still up at the time of reporting.
Rights disputes over licensed music are nothing new for movies and TV, or even games. In fact, the music industry is notoriously tight fisted about how and when they contract out their songs. It’s not unheard of for a piece of media to remove old licensed songs, or even be taken down altogether when the rights expire. Video games like Alan Wake and Alpha Protocol were taken off sale when their music licenses expired, while shows like Scrubs and 13 Reasons Why have had music retroactively changed from their original broadcast versions.
Part of this is due to the fact the music industry licenses out songs for specific formats like Television, but not streaming, and sometimes will refuse to license a song out indefinitely. As a result, if a show or game wishes to move to a different distribution format or the rights expire, it may have to renegotiate the rights, which can be expensive, especially for a product which is no longer in the prime of its life. Hopefully the rights issues behind the Snyder Cut of Justice League are sorted out quickly, and HBO Max is able to put the trailer back up soon so fans can still watch it in the future.
