The organisation says that Joy-Con Drift &ldquo;constitutes an important, serious and hidden defect.&rdquo;<\/p>\n<p><iframe loading=\"lazy\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube-nocookie.com\/embed\/px3geIn0gdM?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/p>\n<p>&ldquo;Hence, Nintendo failed to mention an important fact in a representation made to a consumer: the quality of its products, which is a key element likely to affect the consumer&rsquo;s informed decision in purchasing a product,&rdquo; it wrote on its website.<\/p>\n<p>Joy-Con Drift has become a real problem for Nintendo. In July 2019, law firm Chimicles, Schwartz Kriner &amp; Donaldson-Smith <a href=\"https:\/\/www.vg247.com\/2019\/07\/22\/nintendo-facing-class-action-lawsuit-joy-con-design-issue\/\"  rel=\"noopener\">filed a class action<\/a> against the company over errors with the Switch&rsquo;s controllers. A few months later in September 2019, this case was opened up to <a href=\"https:\/\/www.vg247.com\/2019\/09\/30\/class-action-lawsuit-switch-joy-con-drift-open-switch-lite-owners-now\/\"  rel=\"noopener\">those who owned the Switch Lite<\/a> console, too.<\/p>\n<p>That summer, a leaked Nintendo memo instructed support staff to <a href=\"https:\/\/www.vg247.com\/2019\/07\/24\/nintendo-to-repair-joy-con-drifting-customers-for-free-report\/\"  rel=\"noopener\">repair Joy-Cons with drift issues free of charge<\/a>, no matter if the hardware was under warranty or not.<\/p>\n<p>In the wake of the lawsuit being filed, Jeremy Peel wrote for VG247 that <a href=\"https:\/\/www.vg247.com\/2019\/08\/14\/switch-joy-con-drift-red-ring-of-death\/\"  rel=\"noopener\">this threatened to be Nintendo&rsquo;s Red Ring of Death<\/a>, a reference to the infamous and critical error faced by the Xbox 360.
