That is, it&rsquo;ll be settled out of court.<\/p>\n<p><span id=\"more-788370\"><\/span><\/p>\n<p>Whether using the Xbox controller on either Xbox Series S\/X consoles or PC, players have reported drift cropping up on the new tech, and&nbsp;US law firm CSK&amp;D brought the issue to a US court in April 2020.<\/p>\n<p>The law firm, <a href=\"https:\/\/www.gamesindustry.biz\/articles\/2021-04-19-xbox-controller-drift-lawsuit-to-be-settled-out-of-court\">as per GamesIndustry.biz<\/a>, states that a high volume of Xbox controllers have been affected by drift that crops up after general use of the hardware.<\/p>\n<figure class=\"video\">\n<div class=\"video-container\"><iframe loading=\"lazy\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube-nocookie.com\/embed\/0tUqIHwHDEc?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe><\/div>\n<p><a href=\"https:\/\/www.youtube.com\/watch?v=0tUqIHwHDEc\"  rel=\"noopener\">Watch on YouTube<\/a><\/figure>\n<\/p>\n<p>In an article over at <a href=\"https:\/\/www.theloadout.com\/xbox\/stick-drift-lawsuit-update\">The Loadout<\/a>,&nbsp;Benjamin Johns (a partner at CSK&amp;D) said that going to arbitration is likely the &ldquo;end of the road&rdquo; since the case will probably now never hit a public court.<\/p>\n<p>That said, the firm noted that it&rsquo;s acquired a&nbsp;&ldquo;sufficient volume&rdquo; of drift-afflicted controllers from clients, which it&rsquo;ll be seeking to recover damages for. After conducting its own tests, the firm points to the root issue being with a controller&rsquo;s&nbsp;potentiometer &ndash; <a href=\"https:\/\/www.vg247.com\/2021\/02\/21\/ps5-dualsense-controller-drift-teardown\/\">and it&rsquo;s not the first time we&rsquo;ve heard about that being an issue, either.<\/a><\/p>\n<p>&ldquo;In a general sense, the theory of these cases is that had the drift defect been disclosed, no reasonable consumer would have bought them in the first place,&rdquo; Johns told The Loadout.<\/p>\n<p>&ldquo;At Microsoft, we put all of our products through rigorous quality assurance testing and are committed to providing customers with an unparalleled gaming experience,&rdquo;&nbsp;<a href=\"https:\/\/www.theloadout.com\/xbox\/unresponsive-controllers-solution\"  rel=\"noopener\">Microsoft has told The Loadout<\/a>&nbsp;previously.<\/p>\n<p>The same firm is also involved in class-action lawsuits<a href=\"https:\/\/www.vg247.com\/2021\/01\/23\/nintendo-switch-joy-con-drift-lawsuit-canada\/\"> regarding the Nintendo Switch Joy-Con drift issue<\/a>&nbsp;and the <a href=\"https:\/\/www.vg247.com\/2021\/02\/21\/ps5-dualsense-controller-drift-teardown\/\">PlayStation 5 Dualsense,<\/a> too.
