A Child is the Latest to Sue Nintendo Over Switch Joy-Con Drift

While Nintendo is enjoying an otherwise very successful year thanks to titles like Animal Crossing: New Horizons and Super Mario 3D All-Stars, but the company is still facing pressure and lawsuits regarding the Joy-Con drift issue, which has been plaguing Nintendo Switch owners for years.

As a reminder, Joy-Con drift is when one or both of the Joy-Cons’ analogue sticks register inputs slightly in one direction, despite not being touched by the player. Nintendo has even faced lawsuits over this issue. The company is currently being sued by French consumers organization UFC-Que Choisir for anti-consumer practices and intentionally allowing these faulty products to be sold. And now even a child has filed a lawsuit against it.

To be more specific, the child’s mother, one Luz Sanchez, has filed a class action lawsuit against Nintendo, who accuses it of not doing enough to fix or address the Joy-Con drift issue, even in spite of Nintendo offering to fix faulty Joy-Cons for free, and asks for $5 million in damages.

According to the complaint, which was filed in Northern California, Sanchez bought a Switch for her son in December 2018. Only a month later, the Joy-Cons began experiencing the drifting issue and eventually became inoperable for general gameplay use in less than a year. Sanchez proceeded to buy another set of Joy-Cons, only for those to suffer from the same issue after seven months.

Much like the UFC Que-Choisir lawsuit, Sanchez’s lawyers argue that Nintendo is knowingly distributing faulty products to customers without informing them of the defect and also accuses Nintendo of having a financial motive to not properly fix the defect, saying that doing so would cost Nintendo a lot of money.

Nintendo’s lawyers have not commented on the case yet, but given how previous Joy-Con drift lawsuits have gone, it’s possible the court won’t rule in Nintendo’s favor. At the very least, these frequent lawsuits haven’t helped Nintendo’s image, with there being an ever growing demand for it to permanently fix the issue. The company was also recently accused of claiming that Joy-Con drift isn’t even a real problem.

In other news, Nintendo has been on the successful end of a lawsuit recently, making one online retailer stop selling Switch hacking devices made by hacking group Team Xecuter and received $2 million in damages, though this was settled out of court. Earlier this week, two members of said hacking group were arrested and charged with fraud.
