Gamer Files Lawsuit Against Nintendo Over Joy-Con Drift and Wins

While most players have been enjoying their Nintendo Switch consoles that doesn’t mean it’s been a blemish-free experience. Since the system launched back in 2017, countless players dealt with an odd issue where their Joy-Cons struggled to stay connected to their Switch. However, last year saw the discovery of the infamous Joy-Con drift, a problem so prevalent it caused multiple gamers to file lawsuit against the classic video game company. Now it turns out that one UK gamer took Nintendo to court over their Joy-Con issues and returned victorious.

For those that don’t know, Joy-Con drift is an issue within the controllers where the joysticks read directional input from the player even though they aren’t using it. The drifting issue has been such a widespread problem that many players began investigating if a class action lawsuit was possible. In an attempt to make good with its community, Nintendo then offered players the opportunity to send in their Joy-Cons to be fixed for free.

This Joy-Con repair program was exactly what one Reddit user was attempting to use before they ended up filing suit against Nintendo. Reddit user crownshots explained in a post about how they had sent in their Joy-Cons to have their drifting issue fixed twice with each taking over a month to be sent back, they then requested a partial refund from Nintendo.

However, the person they spoke to stated that refunds were not possible and that repairs were their only option. After crownshots seemed to inform the Nintendo employee that this didn’t make sense and was illegal, the Nintendo employee then told them to seek legal action and hung up. With this curt response in mind, crownshots followed the employee’s advice and opened a case with a small claims court. Despite Nintendo not responding to the claim until after the allotted 21 days, the company then reached out and gave crownshots instructions on how they could claim their refund.

While this may seem like a small win for consumers, it’s important to note Nintendo’s history with legal disputes. The company seems quick to file lawsuits against those that it believes have violated their copyright claims, and as such has a strong legal team on hand at all times. While Nintendo typically wins those cases, it has found that winning Joy-Con related disputes seem to not go in its favor. It seems like Nintendo might have to embrace the idea that Joy-Con drift is a problem that deserves more than an apology and a month long repair solution that might not work.
